Interim order

May 17, 2018

Victoria, BC

Nature of Action

Pursuant to section 35(1)(b) of the Health Professions Act (the “Act”), the Inquiry Committee (the “Committee”) made an order to suspend this registrant’s certificate of registration pending the outcome of the CRNBC’s investigation into a complaint made regarding this registrant’s nursing practice. The interim order will stay in effect during the investigation of the complaint and, if as result of the investigation the Inquiry Committee instructs the Registrar to issue a citation for a hearing under s. 33(6)(d), pending the resulting hearing of the Discipline Committee.

The registrant is employed in a senior management and educator position and was responsible for overseeing the clinical services provided to adults with physical, mental, and intellectual impairments and disabilities. The registrant was also responsible for overseeing protocols and care plans for the resident adults and providing “on call” nursing support. CRNBC received a complaint about the registrant from a family member of an adult resident (the “Resident”). The complaint alleged, in part, that the registrant:

  • Failed to establish proper policies and protocols for the delegation and assignment of tasks to residential workers in relation to aspects of the Resident’s care
  • Failed to properly train residential workers to provide the delegated and assigned tasks of care for the Resident
  • Failed to appropriately supervise residential workers in the provision of the delegated and assigned tasks of care for the Resident
  • Failed to make herself available to the residential workers providing care to the Resident to receive updates on the Resident’s health and to answer questions about the Resident’s care
  • Failed to attend the Resident at her residence to assess her health condition for the purpose of making decisions about her care

The Committee was satisfied that the information available indicates that there is a risk to the public which is real and immediate and which requires that the public by protected by an interim order to suspend the registrant. The Committee took the least severe interim action it considered necessary to protect the public.

Important Note:

Any limits, conditions, and/or suspensions ordered by the Inquiry Committee under section 35(1) of the Act are made to protect the public during an investigation or pending a hearing of the Discipline Committee. Measures taken under section 35(1) of the Act pertain to matters which are and remain unproven unless admitted by a registrant or determined by the Discipline Committee.
