Consent agreement

On March 4, 2019 a panel of the Inquiry Committee approved a Consent Agreement between BCCNP and James Roberts of Victoria, B.C., to remediate practice issues related to privacy and confidentiality and failure to disclose  required information to the regulator.

Specifically, when the Registrant renewed his registration in 2008/2009 he did not disclose, as required and as noted on the renewal materials, that he had had criminal charges. In addition, the Registrant accessed information about numerous patients while at work (i) despite not being in a care relationship with the patients (ii) despite some patients being in a different hospital and (iii) despite there being no other legitimate work purpose for viewing or accessing patient information.

As a result, the Registrant has voluntarily agreed to a 2 month suspension of practice, a reprimand, remedial education on ethics and privacy and confidentiality, and sessions with a BCCNP practice consultant.

The Inquiry Committee is satisfied that the terms will protect the public.
